INDUSTRY-SPECIFIC CONTEXT

Education connected to the work behind the regulation.

The USCG pathway uses the shared safety-education engine while clearly distinguishing the way Coast Guard rules incorporate Part 40 for drug testing and address alcohol testing separately.

What this program does—and does not do

  • Part 40 applies to USCG drug testing when incorporated by Coast Guard regulations.
  • Part 40 does not apply to USCG alcohol testing in the same manner.
  • Education must not be described as Coast Guard approval or automatic credential reinstatement.

COMMON QUESTIONS

About the USCG pathway

Does 49 CFR Part 40 apply to every USCG alcohol-testing matter?

No. DOT guidance explains that Coast Guard rules incorporate Part 40 for the drug-testing component, while alcohol testing is addressed differently. The applicable maritime requirements should be reviewed for the individual case.

Does completing the course restore a merchant mariner credential?

No. A certificate documents course completion only. It does not constitute Coast Guard approval, credential reinstatement, or a fitness determination.
